Balochistan High Court on Tuesday ordered extradition of the accused nominated in the killing of Nawab Akbar Khan Bugti in Kohlu district of Balochistan in August 2006. The Division Bench of the High Court consisted of the Chief Justice Balochistan High Court, Qazi Faez Essa and Justice Ghulam Qadir Mengal.
Earlier, the petitioner, Nawabzada Jamil Bugti, one of the sons of late Nawab Akbar Khan Bugti through his counsel stated before the court that the authorities had failed to arrest the accused nominated in the FIR. He also prayed to the court to order that the minutes of the then federal, provincial cabinet meetings are made part of the investigation and the investigation process is expedited. The petitioner also sought detention of the accused who are in Pakistan and arrangements for the arrest of some of the accused who are abroad in countries with whom the Government of Pakistan has not signed any extradition treaty.
Subsequently, the court ordered the extradition of the accused who are in countries with whom Pakistan has signed Extradition Treaty. It also ordered that the record of the then federal and provincial cabinets is obtained and made part of the investigation.
The High Court also ordered the investigation team to examine the correspondence to and from the office of the former president Pervez Musharraf and include every material which may be helpful in the investigation of the case. The court also ordered the government of Balochistan and the Investigation Team to ensure that the probe continues in accordance with the law and at the right pace.
The court rejected the petitioner's pray for extradition of the accused in countries which had signed no Extradition Treaty with the government of Pakistan. In their statements submitted in the court, former governor Balochistan Owais Ahmad Ghani and former Interior Minister Aftab Ahmad Khan Sherpao had stated that they had no knowledge or had any role in the operation during which Nawab Akbar Khan Bugti was killed.
