Senior lawyer Aitzaz Ahsan said on Friday that government was resorting to delay in every matter of importance, adding that had the Executive started investigation into Memogate scandal on time there would have been no need of any judicial intervention. According to him, it is clear that there are many precedents in relation to formation of judicial commission without issuance of a notice to federation.
While talking to media persons in the premises of Supreme Court, Ahsan said that SC could not perform the role of a trial court. According to him, it is time for SC to proceed on the Memogate controversy with due diligence. There is judicial activism all over the world, he added.
In reply to a question, he said that if remedy seekers did not get relief from the Executive and the Parliament then they would rush to superior judiciary. However, he made it clear that the judiciary was an alternate of Parliament. He said Husain Haqqani was not involved in the controversy because he had not only tendered resignation but also handed over his blackberry to government to examine it. Aitzaz contended that there was no contradiction in Parliament and Parliamentary Committee on the issue of national security, adding that the committee could initiate investigation on its own, but usually it did not intervene in such matters.
He said that there were two contradictory reactions from PPP on Memogate issue. However, he opined that Prime Minister's reaction on the scandal was "quite reasonable". Ahsan added that it was wrong to say that federation's contention was plausible, adding that the SC had heard the AGP's point of view being representative of the federation.
