The Federal Board of Revenue (FBR) has expressed serious concerns over delay in the implementation of court orders, causing embarrassment for the tax authorities. Sources told Business Recorder here on Wednesday that the delay in the implementation of the court orders in certain cases has resulted in contempt notices to the Board.
This has prompted the FBR Legal Wing to immediately issue instructions to the top tax managers to avoid such an incidence in future. The FBR Member, Legal, Aqil Usman, has issued instructions to FBR Members here on Wednesday to this effect. The Member Legal directives are: it has been observed that the senior officers of Federal Board of Revenue are facing awkward position before the superior courts on account of delay in implementation of the court orders. In some cases the criminal petitions have been filed and notices for contempt of court have been received by the Board.
All the Members of FBR are accordingly requested to direct their lower hierarchy at FBR and field formations under their jurisdiction to implement the court's decisions in letter and spirit within stipulated time to avoid any subsequent adverse orders by the courts except in those cases where the courts have granted stay against any of such decision/order or the department has filed review petitions/appeal and requested for stay, Aqil Usman said. Director-General Intelligence and Investigation, FBR, Inland Revenue and Director-General Human Resource Management (HRM) are also requested for similar action to implement court orders, FBR Member Legal added.
