Plea against acceptance of Awan's nomination papers: LHC dismisses petition as non-maintainable

The Lahore High Court on Thursday dismissed a petition challenging acceptance of nomination papers of Senator Babar Awan by Election Commission of Pakistan (ECP). Earlier, counsel for Awan Barrister Syed Ali Zafar presented documentary proofs to substantiate his case. The court after hearing all the parties at length dismissed the petition as non-maintainable.
Petitioner Shahid Jamil submitted that Babar Awan had accumulated assets, which mismatched the amount of income tax paid by him. He also accused Babar Awan of not paying agriculture income tax. He submitted that Babar Awan had ridiculed higher judiciary for which Supreme Court had already suspended his license.
The petitioner further said that Awan was registered as voter in Rawalpindi whereas he resided in Islamabad and had no property in Rawalpindi. He pleaded the court to set aside the order of Election Commission of Pakistan to accept the nomination papers of Babar Awan for Senate elections. Awan counsel contended that on the basis of established principles of law the instant petition was not maintainable and liable to be dismissed because it only contained allegations without any conclusive evidence or proofs.
