Sindh Ombudsman Asad Ashraf Malik has ordered legal action against the concerned officers, owner/ builder involved in alleged unauthorised construction on plot No-163/4, street No-16, 'E' Road, Behar Colony, in Lyari Town of Karachi.
He also directed the concerned departments and agencies not to issue NOC for such illegal buildings, an official statement said Sunday. According to details, one Javaid Mushtaq complained to the Sindh Ombudsman that a building was being constructed illegally on above mentioned plot in Lyari Town in violation of KBCA by-laws.
Complainant stated that the original permission was given for ground plus 2 floors but the builder went on for constructing 06 floors on the said plot.
He also complained that the adjacent house No-163-A had developed cracks due to the illegal construction. The builder converted the plot No-163/4 into a commercial mess while Behar Colony is a residential area.
Provincial Ombudsman Sindh ordered for an enquiry and after thorough probe and investigation it was found that a building comprising ground plus 6 is being constructed unauthorisedly. But, no action was taken against this illegal construction by KBCA which indicated the involvement of officials of KBCA/ SBCA.
All this showed that the officials of Lyari Town, SBCA were involved in corrupt practices and mal-administration resulting into unauthorised construction of buildings, creating multifarious problems for the citizens.
The Ombudsman in his decision directed Director General of Sindh Building Control Authority to take severe disciplinary action against the officials of Lyari Town, SBCA during whose period the building was constructed; and also to take legal action against the landowner and the builder for raising illegal construction.
He also asked the Member (RS&EP), Board of Revenue to issue directives to Registrar / Sub-registrar not to register lease documents without confirming that the building was lawfully constructed. Besides the Ombudsman asked Managing Director, Sui Southern Gas Company, and MD, KESC to issue instructions to the concerned departments not to provide gas/ electricity to the buildings which were unauthorisedly constructed.
They should seek clearance and confirmation from the SBCA in respect of multi-storeyed buildings. The Provincial Ombudsman has asked for compliance report with 45 days.
