KARACHI: Sindh High Court (SHC) on Thursday ordered removal of the name of Ijaz Jakhrani, Advisor to Sindh Chief Minister on Prison & Inter Provincial Coordination, from the Exit Control List (ECL).
An SHC bench comprising Justice Muhammad Iqbal Kalhoro in a written order stated that Jakhrani filed the petition in the court against letter dated 14-06-2019 and memorandum dated 03-07-2019 placing his name on ECL.
Petitioner sought removal of his name on the grounds, among others, that the same are against his fundamental rights guaranteed under Articles 4, 9, 14 and 15 of the Constitution and in disregard to various pronouncements of the superior courts on the issue.
Order stated that a perusal of record shows that impugned action has been taken against the petitioner on the recommendation of the National Accountability Bureau (NAB) in view of apprehension of his absconding in an enquiry into the allegations of accumulating assets beyond source of income initiated against him in the year 2018.
In the course of hearing, court was informed that after completion of enquiry/investigation a reference has been filed against the petitioner before the Accountability Court at Sukkur and apart from it two other enquiries in respect of different allegations have been undertaken by NAB against him.
Defence counsel stated that by now it has been settled that mere pendency of a criminal case or investigation will not form a valid ground for placing name of a person on the ECL.
