Chief Justice of Pakistan Iftikhar Mohamamd Chaudhry has said that missing persons' issues has become a global issue, but the court will not go beyond constitutional limitations and seek an amicable solution. A three-member bench of the Supreme Court comprising the Chief Justice, Justice Jawwad S Khawaja and Justice Khilji Arif, was hearing the petition pertaining to the law and order situation in the province filed by the Balochistan Bar Association.
"We want the Parliament to resolve the problems faced by an ordinary man in the country as they are the representatives of the people unlike General Musharaf (Retd), who toppled the democratic government," remarked Justice Khilji Arif on the suggestions made by senior lawyer Hadi Shakeel about the possible way out of the prevailing law and order situation in Balochistan.
The Chief Justice said that despite receipt of huge funds under the 7th NFC Award, there was no industry, no reforms in the agri-sector on the ground and no jobs available in the province. Create means of earning and ample jobs opportunities if authorities concerned want to end lawlessness, he added. On the increase of doctors' killing, the bench asked the Chief Secretary Balochistan and CCPO Quetta to apprise the plan for the security of the doctors. To which, the CCPO said that after taking doctors on board, they had devised a concreted strategy to protect the senior doctors.
Referring to the appearance of BNP-M leader Akhtar Mengal, Speaker Balochistan Assembly Mohamamd Aslam Bhootani and JWP leader Talal Akbar Bugti before the court, the Chief Justice said that their statements were good signs which should have been cashed in for finding out a solution to the prevailing situation.
"We could agree to the Chief Secretary Balochistan, who denied that no operation was being conducted in any areas of Balochistan but the same could be conveyed to Mengal inviting him to identify the areas where he said an alleged operation was going on," Justice Khilji Arif said. The bench was informed about the details of slain and missing lawyers. The CJP asked if the heirs of lawyers and other civilians were paid the compensation.
The bench also asked if the amount of Rs 400,000 had been increased to Rs 1 million as per court directive. To which the CS Balochistan informed the bench that a proposal had already been submitted to the cabinet in this connection and the compensation amount would be enhanced soon. Senior lawyers Munir A Malik, Raja Suleman, M Zafar and Hadi Shakil also appeared in the court and recorded their statements. Speaker Balochistan Assembly Mohammad Aslam Bhootai, IG Frontier Corps Major General Obaidullah Khatak, IG Police Umer Khitab were also present in the court. The bench will continue hearing the case daily till October 12.
