The Supreme Court on Tuesday reserved its judgment in a review petition filed against the formation of a one member commission of Dr Shoaib Suddle. The commission was set up to probe alleged business deal of Rs 342 million between Chief Justice's son Dr Arsalan Iftikhar and business tycoon Malik Riaz Hussain.
A three-member bench of the apex court led by Justice Jawwad S Khawaja and comprising Justice Ejaz Afzal and Justice Chaudhry Ijaz Ahmad resumed the hearing of review petition.
During the course of proceedings, Zahid Bukhari, the counsel for the applicant objected to the constitution of the bench in the instant matter saying the same bench that delivered the August 30 verdict should hear the matter.
Meanwhile, the counsel for Arsalan Iftikhar, Sardar Ishaq, apprised the bench that Malik Riaz Hussain was adopting delaying tactics by not appearing before the commission.
Bukhari told the court that the one-man commission was unacceptable. He further contended that a contempt of court petition would be filed against the Commission, as its continuing investigations, despite the denial of its extension, was tantamount to harassment.
The court reserved its judgment over Bukhari's objections on the bench.
Earlier, submitting an interim report in the apex court, the inquiry commission sought more time to investigate the case and informed the court that the inquiry could not be finalised within the stipulated time of 30 days because of non-co-operation by Malik Riaz and delaying tactics particularly by the Ministry of Interior in providing the required experts/support staff.
