The Federal Board of Revenue has set up review panels at the FBR headquarters as well as regional level to resolve issues arising out of audit selection cases by the Board. In this regard, the FBR has issued an office order here on Tuesday.
According to the office order, to address the issues arising out of audit selection made by FBR under Section 214C of the Income Tax Ordinance, 2001, Section 72B of the Sales Tax Act, 1990 and Section 42B of the Federal Excise Act 2005, the Federal Board of Revenue (HQ), Islamabad is pleased to establish review panels at FBR (HQ) as well as regional level.
The review panel at FBR Headquarter included Member (Taxpayers Audit) Chairman; Member (Enforcement) Member and chief (Taxpayers Audit) Member/Secretary. The Regional review panel would include Chief Commissioner of the concerned RTO/LTU, Chairman; Commissioner of other than the concerned Zone, Member; President/Representatives of local chamber of Commerce & Industry, Member and Additional Commissioner (HQ), Member/Secretary.
On receipt of taxpayer's representation concerning the selection of his case for audit, the Regional Review Panel will examine, in presence of the taxpayer/his AR and the concerned Commissioner, the issue in the light of risk parameters attracted in the selection of his case. After due deliberation, if the issue is resolved and the Panel is able to convince the taxpayer about correctness of selection, the proceedings will be dropped. However if the issue is not resolved recommendations will be furnished to the Board within 15 days of the receipt of representation.
The Review Panel at FBR (HQ) will examine the recommendations of the Regional Review Panel. After due deliberations and seeking further clarifications/information from the Regional Review Panel or the taxpayer, if required, the decision will be made within 15 days of receipt of recommendations clarifications which will be conveyed to the taxpayer as well as the Regional Commissioner concerned, the FBR order added.
