Lahore High Court Chief Justice Umar Ata Bandial on Wednesday upheld the objection raised by registrar's office on a petition against holding office of Chairman PIA by Secretary Defence Lieutenant General Asif Yasin Malik (Retd). The CJ observed that President of Pakistan cannot be made a respondent in constitutional petition and only the federation can be made the respondent. He advised the petitioner to file an amended petition accordingly if he desired.
The petitioner, Saleem Khan, submitted that according to a judgement of the Supreme Court an officer holding administrative office cannot be given another administrative office. He said Malik was already holding the office of secretary defence and in addition of it he was given an additional charge of Chairman PIA. He, therefore, prayed to the court to declare the appointment of Asif Yasin Malik as Chairman PIA as illegal and unconstitutional.
