Violation of Supreme Court order: contractual officers still enjoying official positions
The Sindh government is clearly violating a verdict of Supreme Court of Pakistan as Fazal-ur-Rehman, Dr Fahmida Hussein, Sharafuddin Memon, Anita Ghulamali and other contractual officers are still enjoying their official positions despite the issuance of a contract termination notification in July this year, it was learnt on Thursday.
The apex court, on June 12, had taken exception to the appointment of officers in various departments of Sindh government on deputation and contract basis, and had termed provincial government's act "contemptuous and derogatory."
Following the verdict, the provincial government had issued a notification naming some 13 contractual officers posted on lucrative posts, terminating their contracts within next sixty days.
The notification issued by Services and General Administration department, copy of which is available with Business Recorder, mentioned the names of 13 contractual officers, including Fazal-ur-Rehman, retired BS-22 officer of federal government, working as Adviser to Government of Sindh for Special Initiatives, Dr Fahmida Hussein, retired BS-21 officer of Karachi University, working as Chairman Sindh Language Authority, Hyderabad, Lieutenant General (Rtrd) Syed Iftikhar Hussein Shah, working as Managing Director Zulifqarabad Development Authority (ZDA), Mushtaq Kazmi, retired BS-21 officer of Pakistan Customs and Central Excise department, working as Member, Sindh Revenue Board (SRB), Sharafuddin Memon, working as Consultant BS-20, Home department, Professor Anita Ghulamali, retired BS-20 officer of Education and Literacy department, working as Managing Director, Sindh Education Foundation (SEF), Nazar Muhammad Laghari, Ex-PCS BS-20, working as Consultant, Board of Revenue but posted at ZDA, Muhammad Javed Memon, retired officer of Excise and Taxation department, working as Member SRB, Syed Aley Maqbool Rizvi, retired District and Session Judge, working as Chairman Appellate Tribunal Local Councils Sindh, Syed Hasan Shah Bukhari, retired District and Session Judge, working as Consultant CMIE&ET, Professor Iqbal Memon, retired professor of Surgery, Dow University of Health Sciences, Karachi, working as Principal/Project Director SBBM Karachi, Muhammad Aslam Rana, retired Commodore of Pakistan Navy, working as Principal/Project Director Cadet College, Khairpur Mirs' and Munawar Ahmed Memon, retired BS-18 of PSS working as Consultant SGA&CD.
The notification on the subject "Implementation of judgement of the honourable Supreme Court of Pakistan" had stated that in pursuance of judgement passed in Criminal Original Petition No:89/2011 and other cases, it has been decided to terminate re-employment on a contract basis of 13 officers.
In case the consulting services of officers are considered necessary in public interest, their services may be procured by the administrative department through an open competitive process within sixty days while following a procedure as per part-III (procurement, Consulting Services General Provision) of Sindh Procurement rules, 2010. Their contract appointments shall stand terminated after expiry of sixty days or till the appointment of an employee, whichever is earlier, the notification had explained.
According to sources, all contract officers are working on their positions except Mohammad Javed Memon, a retired officer of excise and taxation, who was member SRB. Memon's contract was terminated on September 28, this year.
All other officers, however, are still working, holding official positions. They are attached with Chief Minister Syed Qaim Ali Shah and other provincial authorities and are exercising their powers unlawfully, sources said.
