The Supreme Court was urged to allow former army chief and President Pervez Musharraf to visit his ailing mother in the UAE in the larger interest of justice. Shahjan Khan filed a petition under Article 184(3) of the Constitution of Pakistan, making Federation of Pakistan through Secretary, Ministry of Law, Justice and Human Rights and Parliamentary Affairs, Ministry of Interior through its Secretary, Ministry of Foreign Affairs through its Secretary and a journalist as respondents.
The petitioner submitted that an English daily has published a news item according to which only the apex court is the forum that can enable Musharraf to visit his ailing mother in the UAE. The petitioner cited certain provisions of the Constitution of Pakistan that guarantee every citizen right to move from each and every place and prayed the court to allow Musharraf to visit his ailing mother.
