The Sindh High Court (SHC) on Wednesday suspended the operation of an administrative letter regarding transfer of Zeenat Ahmed, Director, Military Lands & Cantonments of Karachi region. A division bench headed by Justice Hassan Azhar Rizvi gave this interim injunction on a petition filed by Ms Zeenat, who impugned her transfer letter issued by the director general of Military Lands & Cantonments.
The petitioner said that being an officer of Grade-20, she was working as director of Military Lands & Cantonments of Karachi region. She told the court that she was transferred from the post illegally through a letter issued by the DG of Military Lands & Cantonments in February 2014, but the letter was set aside by the SHC division bench when she approached the court against her transfer. She said that the DG of Military Lands & Cantonments once again issued backdated transfer letter which she received on June 17. According to the letter, she was removed from the post of the director of Military Lands & Cantonments Karachi region and posted as director (F&P) Karachi, which post, she said, does not exist at Karachi headquarters of the department.
The petitioner argued that the letter was unlawful as according to service rules, the DG of Military Lands & Cantonments was not competent authority to pass an order for transfer of officer of a Grade-20 officer. "Only such powers are vested with the prime minister to issue such orders." Citing secretaries of ministry of defence, finance and establishment division, the DG of Military Lands & Cantonments and newly posted director of Military Lands & Cantonments Karachi region as respondents, the petitioner requested the court to declare as illegal her transfer letter.
