Transparency International Pakistan has forwarded a complaint received against Sindh government pertaining to illegal allotment of plots on 350 acres KPT land at Clifton shore, reserved for KPT Tower worth Rs 350 billion to National Accountability Bureau, Sindh to take notice of this illegal act.
The complainant has made following allegations:
1. Chief Minister Sindh, has recently allotted plots on 350 acres land belonging to KPT worth Rs 350 billion, adjacent to new breakwater in front of KDA Block nos 2 and 3. The land has been partially reclaimed by KPT, and is the property of KPT and not Sindh government.
2. The plots have been allotted either as new allotments or in lieu of other plots as, adjustment, under the illegal pretext of hardship case.
3. Many ex KPT chairmen, trustees, and general managers, who were involved in 350 acres KPT land, reserved for KPT Tower Project, are now working in Sindh government, and are in knowledge of the chief ministries' alleged illegal acts of allotting 350 acres KPT land at Clifton shore, reserved for KPT Tower.
Chairman, TI-Pakistan, Sohail Muzaffar in a letter sent to NAB Sindh on August 21 has requested to examine the complaint, in view of following comments:
a) This alleged mega scam appears to be replication of the illegal allotments of 75 acres by Sindh Chief Minister, KPT Land on Mai Kolachi Road in 1989/90. In that scam an ex-chairman KPT and Manager Estate KPT without authority of KPT Board, had issued a letter for transfer of 75 acres land, and corruption cases were filed in Ehtisab Bureau, and subsequently taken up by NAB against trustees and mangers of KPT and Sindh government's ministers and officers.
b) It is reported that NAB Accountability Court has adjudicated the corruption case, and has passed orders that the 75 acres land belongs to KPT, and not to the Government of Sindh, and KPT officers are not responsible for allotment of plots, and therefore exonerated KPT officers.
c) However, KPT Board, on the recommendations of KPT Board Estate Committee which comprised Trustee Muhammad Rajpar, convenor, and Syed Perwez Alam, member, dated 21-3-2013, resolved to allot 75 acres land to Government of Sindh, vide BR No 270 dated 11-4-2013. Muhammad Rajpar and Syed Perwez Alam, did not inform in their Committee report to the KPT Board about NAB case.
d) "The Supreme Court of Pakistan in the suo moto case 16 of 2011, had ordered the Sindh government on November 28, 2012, to restrain the government/Revenue department from mutation, allotment, transfer and or conversion of any state land and or keeping any transaction or entry in the record of rights in this regard in revenue of Sindh till the entire revenue record in Sindh is reconstructed. The conversion of lease for 30 years or of any term up to 99 years shall also be stopped immediately as by this mode the state land is being sold out at throwaway price without participation of public at large, which the law does not permit. Any further conversion or mutation of state land in the record of rights from today onwards would be deemed nullity and would expose the Deputy Commissioner/DCO of the relevant districts besides others to contempt proceedings."
TI Pakistan has requested Director General NAB Sindh, in pursuance of Article 19-A, of the Constitution, to take notice of this alleged illegal act of Government of Sindh specially in view of quoted Supreme Court of Pakistan orders of November 28, 2012 in the suo moto case 16 of 2011, and the Accountability Court Orders in case of KPT 75 acres land case. In case the allegations are found correct, action against all those responsible shall be taken under following Section 9 of NAO 1999, corruption and corrupt practices.
(iii) if he dishonestly or fraudulently misappropriates or otherwise converts for his own use, or for the use of any other person, any property entrusted to him, or under his control, or wilfully allows any other person so to do.
(iv) if he by corrupt, dishonest, or illegal means, obtains or seeks to obtain for himself, or for his spouse or dependants or any other person, any property, valuable thing, or pecuniary advantage.
(vi) if he misuses his authority so as to gain any benefit or favour for himself or any other person, or renders or attempts to render or wilfully fails to exercise his authority to prevent the grant, or rendition of any undue benefit or favour which he could have prevented by exercising his authority. Copies of the letter have been forwarded for the action under rules to Secretary to Prime Minster, Islamabad, Chairman, NAB, Islamabad, Chief Minister Sindh, Karachi, Secretary P&S, Islamabad, Chairman KPT Karachi, and Registrar Supreme Court Pakistan, Islamabad.
