Former army chief and President Pervez Musharraf's counsel on Tuesday urged the Supreme Court to adjourn the hearing of federation's plea against Sindh High Court's (SHC) verdict. A five-member bench of Justice Nasirul Mulk has been constituted to hear on Wednesday (today) the government appeal against the SHC decision through which the high court had allowed the removal of Musharraf's name from Exit Control List (ECL).
Seeking an adjournment of the case, Dr Farogh Nasim, the counsel for Musharraf, submitted that he has to conclude arguments before a Special Court that has been trying his client under Article 6 of the Constitution. "The matter before the trial court requires a lot of detailed preparations which is going on for some days. Moreover, to assist this Hon'ble Court in the instant matter, more time is required by the respondent No 1 [Pervez Musharraf] attorney for preparation and research," Dr Nasim submitted.
He further said in the application that there is no cavil with the proposition that the apex court has to be given a precedence; however, in view of the peculiar circumstances of the matter, the prayer for adjournment is made in the interest of justice. It is pertinent to mention that on September 29 the Attorney General for Pakistan's office had submitted the record along with court's orders in relation to different matters, including the Lal Masjid case, the Benazir Bhutto murder case, the Akbar Bugti case and the judges detention case.
