Khyber Pakhtunkhwa government has tabled a bill called "The Khyber Pakhtunkhwa Injured Persons and Emergency (Medical Aid) Bill 2014" in its provincial assembly to provide medical aid and treatment to injured persons in the province to save their lives and protect their health during emergency.
The purpose of the legislation is the provision of treatment to injured persons on priority where an injured person is brought to hospital would be provided medical aid and treatment without delay, on priority, over and above medico-legal formalities.
The proposed law says:" No police officer or official would interrupt or interfere during the period of an injured person is under treatment in a hospital, except with the written permission of the in-charge of the hospital; provided the such permission would not be given unless it is necessary in connection with an investigation which may be carried out in the hospital so long as the injured is under treatment.
Under the legislation, "no consent of the relatives would be required in certain cases where an injured person requires emergency treatment or operation, the doctor treating or operating the injured person need not wait for the consent of the relatives of the injured persons.
An injured person shall not be shifted to another hospital, unless the doctor is of the opinion that the treatment requires for the injured person is not available in the hospital.
The government will, by notification in the official gazette, notify government hospital having in-patients beds and also having facilities to deal with the emergencies to provide medical aid and treatment to the injured persons. Provided that in areas where hospital with in-patient facility is not available, a rural health centre established by the government in the area, having facility to deal with the emergencies, may be notified as hospital for the purpose of this Act.
The hospital will have a dedicated and trained doctor in emergency case and medico-legal procedures. The government will provide free treatment and care to all the injured persons, immediately, as and when received in the hospital.
After the enforcement of the law, the injured person not to be taken to a police station under no circumstances, while the persons bringing the injured person to the hospital also not to be harassed.
Whoever contravenes or violates the provisions of this Act or the rules made there under shall be punishable with imprisonment which may extend to two years, or with fine not less than Rs10,000 or with both, in addition to any other penalty to which he may be liable under any other law for the time being in enforce."
