The Provincial Ombudsman, Khyber Pakhtunkhwa has decided 447 complaints out of the total complaints received for disposal during 2013 and pending of 2012 after investigation till the end of the last calendar year, said Annual Report of the office for the year. The office of the Provincial Ombudsman, Khyber Pakhtunkhwa was established in January 2011 and mandate was given to investigate public grievances arising out of mal-administration of provincial government agencies and its officials and to provide speedy relief to aggrieved persons in genuine complaints.
During the past three years, the office received 2131 complaints. Most of the complaints have been disposed of, leaving a balance of only 103 complaints at the end of year 2013. In most of the cases investigated during the last 03 years, the complaints pertained to misuse of discretionary powers, favouritism and violation of merit in recruitment, while the other cases related to the complaints of corrupt practices, delay and non-flexible attitude in applying rules and procedure.
The majority of complaints, grievances of the aggrieved persons have been redressed in three or less than three months and most of the findings issued during the preceding of three years have been implemented and relief has been provided to a large number of aggrieved complainants against mal-practices of provincial government agencies.
Highlights of the statistical analysis of complaints shows that 217 complaints were pending from the year 2012 while the total number of complaints received during 2013 remained 764.During the year the provincial ombudsman admitted 333 complaints and 431 were rejected while 550 complaints were investigated and out of them 447 were decided after investigation.
Out of the total decided complaints 263 were decided in favour of the complainants and 80 against them. Out of the total received complaints 64 were either withdrawn or not pressed. 40 complaints were decided outside the jurisdiction of the office and 57 were sent to Wafaqi Mohtasib, 11 were sent to other provinces and 22 were sent to concerned departments for initiating appropriate action.
The largest number of 185 complaints, which was 22% of the total number of complaints, was miscellaneous, while Elementary & Secondary Education Department remained second with 128 complaints, followed by Wafaqi Mohtasib, police department and Provincial Disaster Management Authority (PDMA) with 57, 43 and 43 complaints respectively.
The office, during last year, received 33 complaints against health department and 30 each against Revenue & Estate Department and Finance Department. The office also received 28 complaints against the Accountant General of Khyber Pakhtunkhwa, LG and R.D Department 27, Communication and Works Department 20, Public Health Engineering Department 19, Agricultural Department 15, Higher Education Department 13 and 10 complaints against Administration Department respectively.
The number of complaints against Excise & Taxation Department, Irrigation Department, Environment Department, Home & Tribal Affairs Department, University of Peshawar, Zakat & Ushr Department, Industries Department, Planning & Development Department, KP Public Service Commission, Peshawar, EOBI, Social Welfare Department, Auqaf, Hajj and Religious Affairs Department, Housing Department, Sports, Culture &Tourism Department, remained in single digits. The office during the year received no complaint against the department of Food Department, Information Department, Mines & Mineral Department, IPC Department, Human Rights Department and Science and I.T Department.
In district-wise statistics of complaints the largest number of complaints (148) were received from the provincial metropolis Peshawar followed by 72 complaints from Abbottabad and 67 from the districts of other provinces, 63 from Swabi and 50 from Bannu.
Most of the complaints were relating to delay in the construction of schools, roads etc, that were 129, while 86 were relating to lack of access to information, 77 regarding delay/release/non-payment of salary/GP fund, violation of merit, 59, non-payment/delay/increase of pension 57, appointment against employees' son's quota 53, request for issuance of EOBI card 52, illegal transfer/occupation/encroachment of land 47, up-gradation/promotion/seniority 43, water supply scheme/ scarcity/ drainage system 37, Request for compensation/marriage grant 36, correction in electricity bill 29, Correction of name/provision certificates 29, Request for Shaheed Package/Death Grant 28, Appointment against deceased son's quota 27, reinstatement in service 25, Recovery of dues/tax/pay/fee 24, Correction of date of birth/DMC 22 Allegation amongst private parties 21, illegal/fake/request for, FIR13, highhandedness of SHOs 9 and 5 complaints were also registered against corporal punishments in schools.
