The Supreme Court on Thursday removed registrar's office objection over a criminal petition relating to commuting punishment in a criminal case and issued directives to the concerned office to fix the matter for regular hearing under Article 184 (3). A two-member bench of Justice Ijaz Ahmad Chaudhry resumed hearing of a matter, relating to a constitutional point that how an individual's plea could be entertained under Article 184 (3).
Appearing on behalf of his client, Muhammad Azhar Siddique contended that during 2005 the apex court awarded punishment for 25 years to his client against the intention of Section 311 of the Criminal Procedure Code (CrPC). Under Section 311, maximum punishment could be awarded for 14 years, he said and added that the registrar's office has raised objection over his plea. However, after removing the objection, the bench directed the concerned branch to fix the matter for regular hearing.
