The Islamabad High Court on Wednesday barred the government from taking any action against daily wagers and contract employees working in different departments of the federal government.
A division bench of IHC comprising Justice Noorul Haq N. Qureshi and Justice Athar Minallah heard the petitions filed by the employees working in different federal government departments, seeking suspension of a court verdict which ordered the termination of such employees regularised as per the recommendations of the subcommittee of previous cabinet on regularisation of government employees headed by Syed Khursheed Shah.
During the course of proceeding, the court directed that daily-wagers/contractual employees should not be terminated and salaries of those employees which have been withheld must be released at the earliest. Besides, the court disposed of all the cases pertaining to daily-wagers/contractual employees and ordered the shifting of all those cases to a committee headed by Secretary Establishment.
Counsel for the petitioners maintained that majority of the daily-wagers/ contractual employees have been regularised on the recommendations of sub-committee headed by Syed Khursheed Shah. However, regularisation cases of some employees were still pending. He further pleaded that around 2000 teaching and non-teaching staff working in federal directorate of education have been regularised but the directorate is not taking their joining on regularised basis.
Later, the court adjourned the case till December 17. It is pertinent to mention that subcommittee of previous cabinet on regularisation of government employees headed by Syed Khursheed Shah had regularised all the daily wagers and contract employees of the federal government. However, the IHC single-member bench of Justice Shoukat Aziz Siddiqui on May 29 this year declared the sub-committee unconstitutional, and also ordered termination of such employees regularised under its recommendations. Later on a two member bench of IHC headed by Chief Justice Muhammad Anwar Khan Kasi and Justice Noorul Haq N Qureshi suspended the order passed by the single bench.
