Federal Law Secretary may initiate inquiry against the decisions made by Customs Tribunal's Member (Technical), it was learnt here on Thursday. Sources said the inquiry might be initiated on a complaint lodged by Advocate Munawar Ali Lakho with the federal secretary of law and justice ministry.
According to written complaint, a copy of which is available with Daily Business Recorder, Member (Technical) Islamabad Khalid Mehmood was appointed as Member (Technical) in Islamabad Customs Tribunal with the consent of FBR chairman although the tribunal already had two technical members. The complainant alleged Khalid Mehmood through his decisions not only caused financial losses to the exchequer, but also gave `extraordinary' favours to the blue-eyed persons.
Citing reference of custom appeal (No H-359/2014), which was filed by the Messrs Sattar Electronics against customs authority for seeking relief against the impugned order in original, the complainant said that the documents showed that Messrs Sattar Electronics had no locus-standi to file an appeal as the show-cause notice or order in original did not mention the name of Sattar Electronics. However, the judgement given by Khalid Mehmood on July 18 2014 was in favour of the said company. Similarly, in another appeal (K-820/2014 and K-821/2014), filed by Messrs Polytop Industries, against order in original, was passed by Additional Collector of Customs without the endorsement of the Chairman, a mandatory requirement under the law. Although the matter pertained to a division bench, a single bench of Custom Tribunal had announced two judgements without endorsement against the law, the complainant alleged. Meanwhile, sources said that copy of the complaint had also been sent to the Sindh High Court's Inspection Team's Member for conducting an inquiry against the decisions made by the Member (Technical).
