Prime Minister Nawaz Sharif has imposed a major penalty of dismissal from service upon Muhammad Anwar Goraya (IRS/BS-21) presently posted as Accountant Member, Appellate Tribunal, Inland Revenue, Karachi. In this regard, the FBR has issued a notification here on Friday.
According to the FBR order, whereas disciplinary proceedings were initiated against the said officer (IRS/BS-21) presently posted as Accountant Member, Appellate Tribunal Inland Revenue Karachi, on charges of "inefficiency" and "corruption". The Competent Authority ie Prime Minister appointed Ms Nazrat Bashir, Managing Director Public Procurement Regulatory Authority Islamabad as Authorized Officer. Ms Nazrat Bashir, Managing Director, Public Procurement Regulatory Authority, Islamabad being Authorized Officer appointed Kamran Ali Qureshi, Secretary, Ministry of Science and Technology, Islamabad as inquiry officer to scrutinise the conduct of the accused officer. The inquiry officer furnished report on November 13, 2014 with the findings that the accused officer is found guilty of "inefficiency" and "corruption". On the basis of inquiry report, a show cause notice was issued on December 5, 2014 to the accused officer with the directions to reply within seven days of the receipt as to why a penalty, including Major Penalty of Dismissal from service should not be imposed upon him.
The accused officer furnished reply to the show cause notice on December 19, 2014 and denied charges levelled against him and sought opportunity of personal hearing which was granted by the Authorized Officer on December 20, 2014. After examining the record of the case, defence of the accused officer including reply to the Show Cause Notice and findings of the inquiry officer, the Authorized officer recommended imposition of a major penalty of "Dismissal from Service" under Rule 4(1)(b)(iv) of Government Servants (Efficiency and Discipline) Rules, 1973 upon the said official.
The Competent Authority, ie the Prime Minister after having considered all the aspects and material relating to the case, defence of the accused officer including reply to the show cause notice, findings of the inquiry officer and recommendations of the Authorized officer, has decided to impose a Major Penalty of "Dismissal from service" under Rule 4(1)(b)(iv) of Government Servants (Efficiency and Discipline) Rules, 1973 upon the official presently posted as Accountant Member, Appellate Tribunal, Inland Revenue, Karachi.
In light of above, Major Penalty of "Dismissal from Service" is imposed upon Goraya, Accountant Member, Appellate Tribunal, Inland Revenue, Karachi as laid down in sub clause (iv) of clause (b) of sub rule (1) of Rule 4 of the Government Servants (Efficiency & Discipline) Rules, 1973 with immediate effect.
Accountant Member, Appellate Tribunal, Inland Revenue, Karachi shall have right to appeal to the Appellate Authority under Civil Servants (Appeals) Rules, 1977 within a period of 30 days from the date of communication of this Notification, as provided under the relevant Rules, it added. FBR sources said that the officer was facing three kinds of charges during inquiry, which resulted in dismissal from services. Issuance of bogus income tax and sales tax refunds, patronage of corrupt and notorious officers and glaring violations of FBR instructions.
The officer was going to retire on January 5, but the major penalty of dismissal from service was imposed upon him on January 2. The Sindh High Court has already dismissed his petition regarding stay order against the inquiry against the official, they added.
