The Federal Board of Revenue (FBR) has directed the Collectors of Customs to continue collecting definitive anti-dumping duty on imports of Secondary Quality Tinplate (SQTP) into Pakistan from Belgium, France, Germany, Netherlands and USA. In this regard, the FBR has issued instructions to all Model Customs Collectorates (MCCs) here on Friday.
The FBR has taken action on a letter of National Tariff Commission (NTC) received on the notice of initiation of sunset review of definitive anti-dumping duties levied on dumped imports of secondary quality tinplate into Pakistan from Belgium, France, Germany, Netherlands and USA.
Details revealed that the NTC received an application for sunset review from the domestic industry under Section 58(3) of the Anti-Dumping Duties Ordinance, 2000 (the "Ordinance") following the publication of the notice of impending expiry of the anti-dumping duties imposed on dumped imports of Secondary Quality Tinplate (SQTP) into Pakistan originating in and/or exported from Belgium, France, Germany, Netherlands and USA (the "Exporting Countries"). The applicant has alleged that the expiry of anti-dumping duties would likely lead to continuation and recurrence of dumping of SQTP and injury to the domestic industry producing SQTP.
Upon examination of application the Commission has decided to initiate a Sunset Review in which it will determine whether the expiry of the anti-dumping duties imposed on dumped imports of SQTP would likely lead to continuation and recurrence of dumping and injury to the domestic industry. The notice of initiation of sunset review has been published in newspaper and official Gazette on January 15, 2015. SQTP is classified under PCT No 7210.1210. In terms of Section 58(3) of the Ordinance, the anti-dumping duties imposed on dumped imports of SQTP will remain in force pending the outcome of the review. Therefore, the FBR is requested to kindly continue collecting definitive anti-dumping duties imposed on imports of SQTP from the above mentioned Exporting Countries in accordance with the notice of imposition of anti-dumping duties dated November 14, 2009 until further notice from the Commission. SQTP imported from other than the source mentioned above are not subject to the anti-dumping duties.
