The widow of eminent orthopaedic surgeon late Dr Muhammad Ali Shah, Dr Rehana Shah had moved a petition (SMA 160/2015) in the Sindh High Court over the issue of letter of administration through which she was being deprived of her due rights of share in property and bank deposits.
Dr Rehana Shah had hired services of eminent lawyer Advocate Mehfooz Yar Khan, who is also the President of Amity International. The petitioner in her petition alleged her step son Dr Junaid Ali Shah, who had allegedly managed to obtain letter of administration and a succession certificate in which he had not showed her step mother and a step brother as legal heirs for the due share from the moveable and immoveable property of late Dr Muhammad Ali Shah.
While talking to this scribe, Advocate Khan said the evidences annexed with the petition were enough to prove the letter of administration and onward issuance of succession certificate were obtained on basis of forgery and hence the petitioner had in her petition sought court's role for trying Dr Junaid Shah under section 193 of the Criminal Procedure Code.
He said the evidences also showed that late Dr Muhammad Ali Shah had in his life made it part of his testimony that her spouse Dr Rehana Shah would receive 50 percent share in all of his moveable and immoveable property and bank deposits. In this regard, the court had heard the petition on Monday.
