The Chief Justice Nasirul Mulk Monday decided to form a larger bench to hear a matter relating to disqualification of a parliamentarian under Articles 62 and 63 of the Constitution of Pakistan. Samiullah Baloch had filed a petition in the Supreme Court challenging the membership of MPA Abdul Karim Nousherwani on grounds that National Accountability Bureau has convicted the member provincial assembly.
Babar Awan appeared before the bench on behalf of Baloch raising a question of law whether once an MPA declared disqualified under Articles 62 and 63 could be qualified to be elected or chosen as a member of the Parliament again. The court referred the matter to a five-member larger bench to decide the question of law and adjourned the hearing for an indefinite period.
