Islamabad High Court (IHC) on Monday dismissed a petition filed by four former inspectors general for reinstatement of sacked senior superintendent of police (SSP) Mohammad Ali Nekokara and restoration of suspended police officer Aftab Ahmed Cheema. Four former inspectors general - Iftikhar Rashid, Afzal Ali Shigri, Tariq Pervez and Shaukat Javed had challenged the sacking of Nekokara and suspension of former inspector general (IG) Islamabad Cheema.
The court after preliminary hearing declared the petition not maintainable as the petitioners were not the aggrieved in the sacking and suspension of the officers. The court also observed that under Article 212 of the constitution, the officers can file an appeal against any 'adverse' order in the Federal Services Tribunal. SSP Nekokara as per charge sheet against him had shown 'poor leadership' at the time of a 'grave crisis' (during the three-month long 'sit-ins' in the capital); and IGP Cheema was suspended and disciplinary proceedings initiated against him for 'inaction' against the Pakistan Tehrik-e-Insaf (PTI) and Pakistan Awami Tehrik's (PAT) sit in last year. Additional Attorney General Afnan Karim Kundi, representing the federal government argued that the officers had filed departmental appeals and the matter was pending for adjudication at departmental level after which they could seek redressal from the Federal Services Tribunal (FST).
