The Islamabad High Court (IHC) on Monday issued a notice to the government on a petition seeking cancellation of a bail to an accused allegedly involved in killing a prosecutor of the Federal Investigation Agency (FIA). IHC division bench comprising Justice Shaukat Aziz Siddiqui and Justice Athar Minallah heard a petition filed by Asad Mahmood, brother-in-law of FIA's special prosecutor Chudhry Zulfiqar Ali. The petitioner requested the court to cancel the bail of Abdullah Umar, the accused.
Ali was gunned down on May 3, 2013 while he was on his way to an Anti-Terrorism Court (ATC) of Rawalpindi in connection with the murder case of Benazir Bhutto. The petition contends that Abdullah was arrested and charged with the murder of Zulfiqar; however he applied for arrest bail on grounds of serious medical ailment before the ATC Court.
The petitioner's plea is that Abdullah never submitted any medical report to the court and after his release from jail he has yet to appear before the court in spite of the court's direction to him to appear at each and every hearing. The petitioner's counsel, Mohammad Ishaq Hinjra, claimed that "the neurological examination revealed that the patient was fully conscious, oriented, co-operative and having good memory." IHC division bench after hearing the preliminary arguments adjourned the matter till June 29.
