Ayyan Ali's case: IHC rejects Customs' appeal against court's decision to return passport
Dismissing appeal of the Customs department of the Federal Board of Revenue (FBR) against Special Judge Rawalpindi' decision for returning passports to model Ayyan Ali on the grounds of maintainability on Monday the Islamabad High Court asked the appellant to file appeal in the relevant forum.
Appearing before a single-member bench of Justice Athar Minallah in the case, Ayyan Ali's counsel Latif Khosa contended that Islamabad High Court has no jurisdiction to hear the current matter.
Khosa further pleaded that Special Appellant Court has the authority to adjudicate her client' case, saying that according to a federal government notification Lahore High Court has been granted authority to hear appeals against Special Customs Court Rawalpindi.
After hearing the arguments of both the parties, the bench dismissed the appeal in the matter.
Ayyan Ali was apprehended from Islamabad Benazir International Airport on March 14, 2015 during an alleged attempt to smuggle more than half a million dollars in cash.
