The apex court of Pakistan allowed manufacturer of Rooh-e-Samar to continue its sale till month of Ramadan. The company was allowed sale during the hearing of a matter relating to infringement of trademark and patent right on Friday. Appearing before a two member bench led by Justice Umar Ata Bandial in the matter, Rooh-e-Samar counsel submitted that his client had no competition with any other brand saying his client company's annual income was Rs 130 million as compared to Rooh Afza's sale of Rs 4 billion per annum.
It is pertinent to mention that during last proceedings of the matter, the apex court had asked both the parties to bring samples of their brands at the June 17 hearing in order to ascertain the reality of the product's compatibility. During the course of proceedings, Justice Bandial observed that apparently both the bottles seemed to be unanimous in shape adding that through using identical names nobody would be allowed to make dent to other brand business. He remarked that some illiterate consumers might be confused while purchasing red colour syrup (Rooh Afza or Rooh-e-Samar) because of its colour or name. Hearing of the matter was adjourned till July 12.
