According to media reports, on July 25, based on the advice of the Prime Minister, the President has appointed four new members of the Election Commission of Pakistan. Of these four members, three are former judges of the provincial High Courts, but the fourth member is an ex-bureaucrat.
Article 218(b) of the constitution stipulates that each of the four members of the ECP shall be a judge of a High Court from each province. Given this condition, apparently, by appointing an ex-bureaucrat as member of the ECP, the constitution has been violated by both the Prime Minister and the President.
It is therefore imperative for the Prime Minister to clarify under which provision of the constitution he is empowered to appoint an ex-bureaucrat as a member of the ECP, and the President too must clarify the circumstances under which he approved the appointment of an ex-bureaucrat as a member of the ECP.
