Judicial Magistrate Morgah, Rawalpindi, Ghulam Muhammad Sarfraz Saturday released all three employees including the owner of Kidney Centre, observing all three FIRs against them were lodged illegally and in violation of law.
Appearing before the court of judicial magistrate in the matter, Advocate Abdul Hameed Baloch apprised the court that his clients were there at the office of Deputy Superintendent of Police Saddar Rawalpindi in pursuance of three FIRs registered at Police Station Rawat regarding alleged illegal removal and transplantation of human kidneys and tissues.
Advocate Abdul Hameed Baloch contended that Morgah Rawalpindi Police apprehended his clients including owner of Kidney Centre Morgah, Colonel (Retd) Dr Mukhtar Ahmed Shah, Dr Tauseef Mukhtar Bokhari and hospital supervisor Laeeq Ahmed soon after they recorded statements before the joint investigation team on December 16. Baloch said that his clients were arrested soon after they recorded statements before a joint investigation team at the office of DSP Saddar Rawalpindi in pursuance of FIR registered at PS Rawat regarding alleged illegal removal and transplantation of human kidneys and tissues.
Baloch contended that Rawalpindi police not only humiliated his clients but also detained them without lawful authority for a day, saying the police could not be allowed to misuse power therefore no remand of his clients should be granted.
After hearing the arguments in the matter, the judicial magistrate agreed to the contentions of Advocate Abdul Hameed Baloch and discharged all the three persons observing that all the three FIRs at Morgah police station against the accused persons were registered in violation of the law.
