Prominent jurists have expressed the view that a man who is disqualified for not being Sadiq and Ameen cannot head a political party under the Islamic laws. They were commenting on the decision on the PML-N's central working committee's decision to approve an amendment to the party's constitution, allowing a disqualified member of parliament to lead the party.
Former Judge of the Supreme Court of Pakistan Justice Wajihuddin Ahmad (retd) said the Constitution of 1973 declares the country 'The Islamic Republic of Pakistan', and clearly mentions that Pakistan is basically a democracy, guided by the Islamic principles and values. No law would be made contrary to Quran and Sunnah. He said the government has to make efforts to implement Islamic system (Shariah) in future. Therefore under the objective resolution and Article 2 of the Constitution, any law that permits a disqualified man to head a political would be struck down by the superior courts, former Justice added.
Talking to Business Recorder, prominent jurist and former law minister Dr Khalid Ranjha said that PML-N had unnecessarily adopted a war path against the judiciary whereas several articles and basic structure of the constitution do not allow a dishonest and untruthful man to head a political party. Any such move would be challenged in the superior courts, he added.
