Chairman Awami Muslim League Sheikh Rashid Ahmad Wednesday challenged recently passed election law, which justified Nawaz Sharif to become Pakistan Muslim League-Nawaz president even after the apex court declared him disqualified from holding a public office.
Filing the petition before Supreme Court under Article 184 (3) of the Constitution, Sheikh Rashid Ahmad made Muhammad Nawaz Sharif and secretaries of National Assembly, Senate, Ministry of Law and Election Commission of Pakistan (ECP) as respondents.
Sheikh requested the apex court to declare that Mian Muhammad Nawaz Sharif having been disqualified by the Supreme Court in Panama Papers case on July 28 under Article 62(1)(f) cannot be elected the party head or office-bearer of the PML-N. He also prayed the court to declare election of the Nawaz Sharif as the party head unconstitutional, unlawful, and void to and of no legal effect.
Sheikh Rashid Ahmad further requested the court to declare Sections 203 and 232 of the Election Act, 2017 and the deletion of Khatam-e-Naboowat (Finality of Prophet-hood) Oath through the said Act unconstitutional.
He submitted that disqualification recoded by the court of law under Articles 62 and 63 of the Constitution cannot be overtaken by sub-constitutional law, saying if a person cannot become a parliamentarian due to operation of constitutional law then he surely cannot become head or office-bearer of a political party.
