The Lahore High Court on Tuesday refused to interfere in the policy of Board of Intermediate and Secondary Education B-Form for students for appearing in 9th class examination. The court observed that the courts should refrain from interfering in the policy making domain of the executive. The court held that it was up to the BISE to delineate a requirement of either B form or birth certificate in order to appear in ninth class exam.
Petitioners' counsel Sheraz Zaka submitted that restriction of B-Form had been imposed for 9th class students illegally. He said when a student appears in examinations of class 5th and 8th there is no requirement of submission of B-Form. He said the requirement of B-Form was in violation of fundamental rights as it results in extraction of Rs 2000 from students.
He said when birth certificate already showed the origin and nationality of the students then why Form-B requirement had been imposed on students who had to face immense difficulty. He said the board authorities should be directed to inform under what law the requirement of B-Form had been imposed.
