Father of Naqeebullah Mehsud Tuesday filed a petition in Sindh High Court (SHC) against the Sindh government's notification to declare former SSP Malir Rao Anwar's home as sub-jail and sought cancellation of said notification. Rao Anwar is accused of extra-judicial killing of Naqeebullah in a fake counter. The victim's father Muhammad Khan stated in his petition that personal house of Rao Anwar has been declared as a sub-jail, while a case was pending before the Anti-Terrorism Court in which Rao is an accused of fake police encounter.
Petitioner submitted that inquiry report and Joint Investigation Report (JIT), constituted on the orders of the Supreme Court as well as final charge sheet and supplementary charge sheet in this case, clearly implicated Rao Anwar and his subordinate officers in the fake encounter in which his son was killed.
Petitioner submitted that after the arrest of Rao Anwar on the Orders of Supreme Court, he was produced before the Anti-Terrorism Court and was remanded to police custody. Later, Rao Anwar was remanded to jail custody.
On declaring Rao Anwar's home as sub-jail, petitioner said neither the trial court was informed nor any document was produced before the court to show that Rao Anwar was not being sent to the Central Jail but was being remanded to his own house, which had allegedly been declared as a sub-jail. Secondly, even till today no document such as notification has been produced before the trial court to show that his own house has been declared as a sub-jail where he is comfortably residing. Thirdly, the order of the trial court is explicit in its direction that Rao Anwar is to be remanded to the jail and as a consequence, he could not be kept in any custody or detention premises other than in a jail.
Petitioner prayed that notification of Sindh Government that allowed Rao Anwar's home as sub-jail should be declared illegal and the respondents, or any person acting through or under them to take any action under this notification, should also be restrained from so doing, permanently.
Meanwhile, Sindh High Court (SHC) on Tuesday granted time to Advocate General Sindh to seek the guidelines from Supreme Court (SC) on the action against those officials, who entered into a plea bargain with National Accountability Bureau (NAB). The two-member bench of SHC comprising of Justice Mohammad Kalhoro and Justice K.K. Agha resumed the hearing on the bail petitions of District Account Officer Ghulam Mustafa and others in corruption cases, who later benefited Voluntary Return (VR) Scheme of NAB.
Additional Advocate General submitted in the court that orders of the apex court suggested that action should not be taken against the officials who benefited from VR Scheme. Court observed that then why Sindh Government didn't move SC on this case. It called Sindh Chief Secretary Sindh on rostrum to direct him file an application in SC for seeking guidelines in this regard.
Additional Advocate General also admitted that Mehdi Shah, Secretary Workers Welfare Board is brother-in-law of Sindh Chief Minister. However action was taken against him in accordance with the law.
Court observed that the penalty awarded to Mehdi Shah is minor compared to other who also benefited from VR scheme after found in corruption. "This is discriminatory," court observed.
