Sindh High Court (SHC) on Monday ordered Sindh Government to vacate Islamia College Building and hand it over to Islamic Education Trust (IET) by August 9. The SHC bench gave this verdict in a contempt of court petition against non-implementation of a lower court's judgment in favour of IET.
In December last year, a district court ordered handing over Islamia College building to IET by turning down the claim of provincial government on it. The Trust moved SHC against non-implementation of that order and filed a petition by making provincial Secretaries Education and Colleges and Principle of Islamia College as respondents in the petition
The public prosecutor argued that the IET claim over the building is dubious and contended the petition should not be entertained.
The court, however, observed that petitioner has been fighting the case for the last several years and lower judiciary also ordered in its favour; so, how can the claim be termed unjustifiable.
The petitioner's counsel argued that former IGP Sindh and others also committed contempt of court when they didn't act to implement the orders of the district court that had also forwarded a reference to the high court for vacating the building on March 30 this year.
He prayed to the bench to issue orders for vacating the building as well as punitive action against those officials, who didn't comply with the orders of a district court.
SHC's bench ordered Sindh Government to vacate Islamic College building to IET by August 9 to comply with the court's orders.
Meanwhile, Sindh High Court (SHC) was moved against the arrest of Javed Hanif, former chairman Karachi Port Trust (KPT) and Muttahida Qaumi Movement (MQM)'s candidate for upcoming general election.
Advocate Rasheed A Rizvi challenged his arrest by filing a petition in the SHC. National Accountability Bureau (NAB) arrested Javed Hanif for making illegal appointments in KPT.
Petition stated that NAB chairman directed that no candidate would be arrested before the polling day on July 25. However Javed Hanif, a candidate for Sindh Assembly seat, was arrested by NAB in violation of directives of its own chairman.
The petitioner made NAB chairman and Director General (Sindh) and Sindh Government respondents in the petition and prayed for release of Javed Hanif to contest the election in the light of NAB policy to refrain from contestants prior to the elections.
