Sindh Government has formulated the draft of new Sindh Police Act, which would be presented shortly in the provincial cabinet for approval, Additional Advocate General told Sindh High Court (SHC) on Wednesday.
The provincial law officer told a divisional bench of SHC headed by Justice Hassan Azhar about the new Police Act when it took up the contempt of court proceedings against Chief Minister Sindh Syed Murad Ali Shah and former Chief Secretary Sindh Rizwan Memon over alleged non-implementation of court's orders for formulating the rules to regulate, transfers, postings and tenures of service in provincial police department.
Petitioner Karmat Ali filed a petition in the court that recommendations of IG Police regarding transfers and postings were not being taken care of by the provincial government in violation of court's orders in this regard.
At the onset of the hearing, Advocate General Sindh submitted that his office didn't receive the copy of the petition. Court directed the counsel for petitioner to provide the copies of petition to Advocate General Sindh and Rangers Prosecutor.
Additional Advocate General informed the court that provincial government is reviewing the police laws in Sindh and has devised the draft of Sindh Police Act. "This would be presented in the provincial cabinet for approval," he told the court.
He submitted that new act has taken care of all the aspects of rules related to police force and prayed that court should not take any action until the new act is enacted. Court put off the hearing of the case till the first week of next month to allow the provincial government to complete its work in this regard.
Meanwhile, a divisional bench of the SHC headed by Justice Iqbal Kalhoro directed National Accountability Bureau (NAB) to furnish all the documents pertaining to Javed Hanif, former Chairman Karachi Port Trust (KPT) and member of Sindh Assembly.
The bench was hearing a petition of the accused for bail in misappropriation of public money and illegal appointments in KPT. Javed Hanif was detained by the NAB and contested the election on a provincial assembly seat while in NAB custody.
The NAB Prosecutor informed the court that reference has been sent to Islamabad and would be finalized soon. He contended to give the arguments on the bail petition of the accused once NAB Karachi received the reference from Islamabad after its approval.
Bench ruled that it would hear the bail petition in the next hearing along with the comments from NAB by putting off its hearing for September 24. The NAB framed charges of embezzlement of funds and illegal appointments in KPT against Javed Hanif for allegedly making 940 illegal appointments in KPT without advertising the vacancies against these appointments. The NAB also accused Javed Hanif of causing two billions loss to national exchequer.
Javed Hanif's counsel Rasheed A Rizvi argued that arrest of Javed Hanif is illegal and said that his client has been elected to Sindh Assembly after securing thousands of votes. He also contested the arrest of Javed Hanif before general elections by NAB by going against its own policy of not arresting those contesting the elections.
