The Supreme Court Monday directed the government to remove encroachments along Korang Nullah and make a policy to regularise the illegal constructions in Banigala. A three-member judge bench, headed by Chief Justice Mian Saqib Nisar was hearing a suo motu regarding illegal constructions in Banigala.
The Prime Minister would have to initiate the process of regularization of the area by paying the required fee. Additional Attorney General Nayyar Rizvi presented the survey report of the area. He said the Survey General of Pakistan had surveyed 21 kilometres of land from where Korang Nullah passes through. He said that 613 kanals of land have been encroached upon around the Nullah.
The AAG said that reports of Capital Development Authority, Federal Ombudsman and the Survey of Pakistan are similar.
The Chief Justice said that the encroachments should be removed, adding that Imran Khan had filed an application before the apex court to remove the encroachments from Bani Gala. As now he had become the Prime Minister; therefore, he should examine the issues of encroachments and contaminated water in Bani Gala, he said. As the new government had been installed; therefore, it should resolve the issues and those who had constructed houses illegally should be imposed fines, he added.
The AAG informed that according to the report, Aisha Malik, Waqar Jamal, Tariq Afridi and Bilo Begum had built houses illegally in the area of Korang Nullah. "Bilo Begum has encroached upon 100 kanals of land and constructed the buildings, made plots and some swath of it was being used for agriculture purposes.
The Chief Justice said now it was in the hands of the incumbent government to regularize unauthorized constructions. "If the PM wants to impose fine then start it from himself (Imran Khan)," the CJP said. The government officials first pay the fine themselves and then collect it from others.
The AAG said that garbage at various places has choked the Korang Nullah, which hampers the flow of water. The Chief Justice remarked that the government has to take steps, adding all the encroachments from the passage of Korang Nullah should be removed.
Babar Awan representing Imran Khan told the court that the Prime Minister had held three sessions regarding the matter and the progress is made, but a few days are needed for further progress. The Chief Justice accepting his plea adjourned the matter until Friday. =
The Chief Justice said if the government does not remove the encroachments then they would pass an order on the matter. The court has directed the government to remove encroachments along Korang Nullah and make a policy to regularize the illegal constructions in Banigala.
