Sindh High Court (SHC) on Friday ordered Sindh Chief Minister Sindh Syed Murad Ali Shah and Inspector General of Police (IGP) Kalim Imam to submit replies in 'contempt of court' proceedings against them for non-implementing the court orders.
A division bench of SHC headed by Hassan Azhar Rizvi heard the petition filed by Karamat Ali, Chief PILER and other human right activists against subverting the court's orders in Sindh IG AD Khawja transfer case and made Sindh Chief Minister and others respondents in the petition.
In October, 2017, SHC gave a verdict after the petitioner challenged the government's move to repeal Sindh Police Order, 2002 and its illegal action in transferring then IGP A D Khawja. Court ordered for reforms in posting, transfer and tenure in police department.
In the contempt of court petition against Sindh Chief Minister, petitioner contended that SHC had issued detailed directives to provincial government and federal government in the order for enactment of statutory rules for transfer and postings in police department at all levels.
He submitted that through the decision in October last year, Sindh cabinet returned the draft of Sindh Police (Posting, Transfer & Tenure) Rules 2017 to the IG, asking him to amend the same in the light of recommendations of the committee formed by provincial government. IG revised and amended the draft rules and sent them to Chief Secretary Sindh in December last year.
As per the court's judgment the cabinet is legally bound to consider the draft of rules within 15 days after submitted by IG Police. However, Sindh Cabinet didn't consider the report submitted by IG Police, which petitioner said is non-compliance on part of Sindh Government to implement the court order.
SHC bench ordered Sindh Chief Minister and IG Sindh to submit their replies by Nov 7 when it would resume the hearing on the petition. Meanwhile, a division bench of SHC also issued notices to K-Electric in 'contempt of court' proceedings against power utility for not implementing the court's orders on un-announced power outages in the city.
The petition against K-Electric was filed by Karamat Ali, PILER Chief, who contended that despite the orders of court, the un-announced load-shedding is being still being carried out in the metropolis. Bench ordered to give the copies of petition to K-Electric and NAPRA by putting off the hearing for Oct 31.
