Non-implementation of court's orders: SHC asks Sindh government to furnish reply in a week

Sindh High Court (SHC) on Wednesday granted one-week time to provincial government to submit its reply in petitions, seeking initiating contempt of court proceedings against Sindh Chief Minister and others for non-implementing the court's directives on statutory rules for transfer and postings in police department.
The division bench of SHC resumed the hearing on petitions, which were filed by Karamat Ali, Chief PILER and other human right activists against subverting the court's orders and made Sindh Chief Minister and others respondents in the petition.
In October, 2017, SHC gave a verdict after the petitioner challenged the government's move to repeal Sindh Police Order, 2002 and its illegal action in transferring then IGP A D Khawja. Court ordered for reforms in posting, transfer and tenure in police department.
However, after the transfer of A D Khwaja, new IG Sindh Syed Kalim Imam has been made respondents in a new petition, filed by Karmat Ali due to new government in the province after last general elections. In the contempt of court petition against Sindh Chief Minister, petitioner contended that SHC had issued detailed directives to provincial government and federal government in the order for enactment of statutory rules for transfer and postings in police department at all levels.
He submitted that through the decision in October last year, Sindh cabinet returned the draft of Sindh Police (Posting, Transfer & Tenure) Rules 2017 to the IG, asking him to amend the same in the light of recommendations of the committee formed by provincial government. IG revised and amended the draft rules and sent them to Chief Secretary Sindh in December last year.
As per the court's judgment the cabinet is legally bound to consider the draft of rules within 15 days after submitted by IG Police. However, Sindh Cabinet didn't consider the report submitted by IG Police, which petitioner said is non-compliance on part of Sindh Government to implement the court order.
Provincial government's attorney told the bench that IG Sindh's reply has been received, which is needed to be reviewed by Advocate General before its submission in the court. "AG Sindh is in Islamabad and would review the reply after his return to Karachi," he told. Provincial government's prosecutor sought one-week time to submit the reply of IG Sindh, which SHC bench granted.
