A division bench of the Lahore High Court on Tuesday granted post-arrest bail to Tehreek-i-Labbaik Pakistan (TLP) chief Khadim Hussain Rizvi and patron-in-chief Pir Afzal Qadri in a case of leading violent protests against acquittal of Aasia Bibi. The bench comprising Justice Muhammad Qasim Khan and Justice Asjad Javed Ghural allowed the bail of Khadim Rizvi on merits while that of Afzal Qadri on medical grounds till July 15.
To the effect of Khadim Rizvi, the bench observed that the petitioner was about 54 years of age and according to a report of National Institute of Cardiovascular Diseases, wholly incapable of moving his half body. It noted that the prosecution had not refuted the medical report.
While on the petition of Afzal Qadri, the bench observed that the petitioner's counsel presented two documents/affidavits showing repentance on his speeches. However, the judges abstained from commenting on affidavits at the stage of decision of bail matter.
The bench observed that Afzal Qadri, 68, had been ailing from heart disease and had also undergone Coronary Artery Bypass Grafting (CBG) surgery and then again CRT-D implantation and now was using pace maker. "Therefore, in order to provide an opportunity to the petitioner to get himself medically treated in an institute of his preference, we admit him to interim post arrest bail, the bench observed and adjourned the matter to July 15. The bench directed Afzal Qadri to appear before the court on next hearing along with entire record relating to his treatment.
