Supreme Court (SC) on Friday rejected the plea against cancellation of bail to an accused in a road accident, in which a 22-year old motorcyclist was paralysed after he was hit by a vehicle.
At Karachi Registry, a three-member bench of SC headed by Chief Justice of Pakistan (CJP) Justice Asif Saeed Khosa heard the application against the accused, who was driving a van that hit the motorcyclist. Sindh High Court (SHC) approved the bail of the accused, which was challenged in the apex court.
Justice Khosa addressing the counsel for petitioner remarked that why he wanted to award punishment to the accused when it is still to be decided. He said that court is sitting here to dispense justice rather than doing injustice.
Chief Justice replied that trial court would take the case on its turn and SC can't direct trial court to take this case by putting aside the other cases when petitioner requested the court to direct trial court for taking this particular case on priority basis.
Justice Khosa remarked that the petitioner wants to soothe his ego by keeping the accused in jail and rejected the plea to cancel the bail of accused Rashid.
Meanwhile, in another case, SC bench headed by CJP Justice Asif Saeed Khosa observed that it is inappropriate to cancel the bail when trial of a case is in the final stage when the bench took up the plea of Anti-Narcotics Force (ANF) to set aside the bail of Hazur Bux, accused in drug possession case.
ANF prosecutor told the court that SHC wrongly interpreted the chemical examiner report, which led to the bail of the accused. He contended that the basis for granting the bail was not justified.
Court, however, rejected the plea by giving the observations that it is inappropriate to cancel the bail on this stage when trial is near to its conclusion.
Court, however, termed the interpretation of SHC in this bail verdict inappropriate when ANF counsel sought the court's observations in this regard.
Later, CJP Justice Khosa chaired the meeting on police reforms at Karachi Registry of SC, in which top police official of provinces and AJK participated.
Meeting discussed the issues related to police reforms and consultation was done for amendment in police laws. Police officials appraised the court about the various clauses of police laws.
