The Supreme Court on Thursday summoned Chief Secretary Sindh and provincial Secretary Cultural Department over new constructions for National Academy of Performing Arts (NAPA) at historical Hindu Gymkhana premises.
The SC bench headed by Justice Gulzar Ahmed directed both officials of Sindh Government in a petition, filed by Hindu community against allocating Hindu Gymkhana to NAPA in Karachi Registry. The bench showed its annoyance over constructions in historical buildings.
Justice Gulzar questioned that how a new assembly building was raised at the premises of historical Sindh Assembly. Didn't Sindh government know that Sindh Assembly was a pre-partition structure, Justice Guzlar observed.
Justice Sajjad Ali Shah stated that new Sindh Assembly building has its own stories as how its construction cost war increased. "We know who went abroad for even purchase of tiles and showers of washrooms", Shah said.
Justice Gulzar also inquired about the threat for raising the walls of assembly building as national assembly and provincial assemblies buildings of three other provinces have no walls. Even the Supreme Court and the Sindh High Court didn't raise the walls of their buildings, he stated.
Deputy Advocate General Sindh told the court that increase in members of provincial assembly led to the construction of new building, at which court asked then why the same was done in Punjab Assembly.
Justice Gulzar said that building of NAPA would have to be demolished one day and said that how structure was raised in a historical building.
The petitioner told the court that Hindu Gymkhana was established for the welfare of the Hindu community. However, Cultural Department allowed constructing the building of NAPA in its premises, which is not allowed in the historical sites.
The court inquired about Secretary Cultural Department Sindh and observed he didn't appear before the court. The court, then directed Chief Secretary Sindh and Cultural Secretary to appear in the court for hearing of the case.
Meanwhile, the SC bench turned down the verdict of Sindh High Court (SHC) Hyderabad Circuit in new inductions in Health Department Mirpurkhas and restrained the government from new appointments in the department.
Petitioners, who were inducted in health department in 2015 moved the court that they are not being given postings despite their appointments four years back whereas new appointments in the department have been advertised. Court also ordered to suspend the new advertisement.
The court observed that first people are inducted by taking the money from them and after that they are deprived of salaries. Justice Sajjad Ali Shah took exception to the Sindh Government and remarked that it seems to "on sale".
Justice Gulzar said that government is doing nothing and each and everyone is doing work on its own whims and wishes. Justice Gulzar also reprimanded DHO Mirpurkhas for being ignorant about rules and regulations.
