SHC reserves verdict in companies' hirings through contractors

The Sindh High Court (SHC) on Tuesday reserved the judgment in a petition against hiring of employees in private companies through contractors.

The Sindh High Court (SHC) on Tuesday reserved the judgment in a petition against hiring of employees in private companies through contractors.

Petitioner Tariq Mansoor Advocate moved SHC against the law of provincial government that allowed the hiring of employees by private companies through contractors, which was passed in 2016.

Petitioner contended the Sindh government enacted this law in violation of constitution and argued that it has been complying with its own law.

Petitioner requested the court to declare this law illegal or issue directives for amending it.

Court asked the petitioner to tell the court as how has he been affected by this law. "This petition should be a person who has been affected by the law", court observed.

Petitioner told the court that he filed the petition in the public interest, at which court remarked that you want the employees to lose whatever job security they have by striking down this law.

Court said that institutions are functioning to implement any law, which had not been complied with so far.

Government's attorney told the court that the law was passed for the welfare of the employees working in the private companies. Attorney said that petitioner should have moved the court to implement the law rather than seeking its annulment or amendment in it.

Meanwhile, the SHC adjourned the announcement of judgment in bail plea of Rauf Siddiqui, former Sindh Minister and other accused in illegal inductions in Sindh Small Industries Department reference.

Court will announce the decision of the bail petition on December 17, 2019. Eight accused including Rauf Siddiqui have been charged for causing losses to national exchequer by making illegal appointments in Sindh Small Industries Department from 2008 to 2014.
