Pakistan Tehreek-e-Insaf (PTI) leader Babar Awan on Monday categorically said that an appeal could be filed in the Supreme Court against the high treason case verdict by former president Pervez Musharraf in his absence.

Speaking at a presser here, he said that Maryam's application for removal of her name from exit control list (ECL) had been rejected by the federal cabinet's sub-committee that deals with such cases. "The sub-committee has decided against allowing a convict to leave Pakistan. There is no such provision in the law. If anyone wants this condition is included then the matter will have to be taken up in the Parliament," he said.

The cabinet sub-committee was directed by the Lahore High Court to review Maryam's plea seeking the return of her passport and one-time permission to fly to London for six weeks to see her ailing father, ex-prime minister Nawaz Sharif.

About challenging the Special Court's verdict, he said that the apex court verdict - SCMR 1999, page 1619 - given by the then Chief Justice Irshad Hussain, clearly says that "an appeal can be filed in absence of an accused."

He said that government would adopt legal and constitutional procedure in Gen Musharraf's case and may approach the apex court against the verdict in the high treason case.

He said that some 'elements' were relating the clash of institutions with para 66 of the verdict, adding that in the presence of Prime Minister Imran Khan no such clash will occur as it is only a wish of some elements who want to destabilize the country.

He mentioned that clash among institution only occurred in 1997 when known politicians, leaders and senators attacked the court of Justice Sajjad Ali Shah and most of them at the present moment are out of the country.

He rejects the rumors of an in-house change, saying the 'elements' talking about such a change had already kissed the dust which is evident from the prevailing situation.

In an obvious reference to former prime minister Nawaz Sharif's health, he said those pretend to kill or deliberately produce symptoms of illness in themselves could be seen quite healthy the moment they landed in London.

He said that some 'elements' have been trying to destabilize the PTI government from the day one, adding the PTI government wants to turn the Parliament into a voice of the poor masses and not merely a house of speeches. Regarding the brutalities of India in Occupied Kashmir and over the minorities within the country, he demanded the United Nations (UN) suspend India's membership through imposing article 6 of the UN charter over passage of controversial laws and brutalities against the people.
